Terms of Service

These Terms of Service ("Terms") are an agreement between you and Themecation LLC ("Themecation," "we," "us," or "our"). They cover your use of the Themecation website, web app, future mobile apps, emails, and related services (together, the "Service").

Themecation helps people plan themed staycations and at-home cultural experiences โ€” meals, activities, shopping lists, and shared adventures โ€” with the help of AI and a community library of plans you can browse, save, customize, and share.

In plain English: by creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please don't use Themecation.

Don't misuse the Service, post unlawful or abusive content, or interfere with how Themecation works for others.

AI suggestions aren't advice

AI-generated plans can be wrong or incomplete. They're not medical, legal, safety, or professional advice โ€” verify before you rely on them.

Paid features & gifts

Some features may be paid. Where offered, billing, gifts, and cancellations are handled through our payment providers and these Terms.

1. Who we are and accepting these Terms

The Service is operated by Themecation LLC.

By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you are using Themecation on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Eligibility and age

You must be at least 13 years old to use Themecation. The Service is primarily designed for adults and older users planning experiences for themselves, their families, friends, or groups.

If you are under 18, you may use Themecation only with the involvement and permission of a parent or guardian who agrees to these Terms on your behalf.

Planning for children

Parents and guardians may use Themecation to plan family experiences, but should avoid entering unnecessary personal information about children. See our Privacy Policy for how we handle children's information.

3. Your account

To use most features, you create an account using your email address. You are responsible for the information you provide, for keeping your login credentials secure, and for activity that happens under your account.

Please give us accurate information and keep it up to date. Notify us at hello@themecation.com if you believe your account has been accessed without your permission.

You may stop using Themecation at any time. To request deletion of your account or associated data, contact us at hello@themecation.com; we will handle the request as described in our Privacy Policy.

4. Acceptable use

When you use Themecation, you agree not to:

  • use the Service for anything unlawful, harmful, deceptive, or abusive;
  • post or publish content that is unlawful, infringing, hateful, harassing, threatening, sexually explicit, or that exploits or endangers others, especially minors;
  • impersonate another person or misrepresent your affiliation with anyone;
  • upload content you don't have the rights to share, or that violates someone else's intellectual property, privacy, or other rights;
  • attempt to break, overload, reverse engineer, scrape at scale, or interfere with the Service or its security;
  • use the Service to build or train a competing product, or to resell or redistribute Themecation content without permission;
  • misuse AI features to generate unlawful, unsafe, infringing, or deceptive content; or
  • circumvent moderation, rate limits, or access controls.

We may remove, hide, limit, or decline to publish content, and may suspend or limit accounts, that appear to violate these Terms or that are unsafe, abusive, unlawful, misleading, infringing, or inconsistent with Themecation's purpose.

5. Your content and public Themecations

You keep ownership of the Themecations, activities, meals, shopping lists, profile details, notes, and other content you create or upload ("Your Content").

To operate the Service, you grant Themecation a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to format, resize, or generate previews), display, and process Your Content so we can run, improve, secure, and provide the Service to you.

If you publish a Themecation or creator profile, you additionally grant us and other users a license to view, save, clone or "make mine," adapt, and share that public content within the Service, and you grant Themecation the right to display it publicly, including to visitors and search engines. Public content may include titles, summaries and descriptions, destination and theme labels, day and activity content, hero media, shopping and prep items, sanitized outbound shopping links, and creator attribution when you enable it.

You can unpublish or delete your own content where the app provides those controls. However, copies or references may persist in search engines, social platforms, caches, backups, screenshots, or other users' saved plans after content has been public. You are responsible for Your Content and represent that you have the rights needed to share it.

We may use automated systems, including AI moderation, to review public content before or after publication. You are not required to publish anything; publishing is your choice.

6. AI-generated content

Themecation uses AI to help generate and improve content, including itineraries, meals, activities, shopping lists, images, summaries, moderation results, and recommendations. To make these features work, information you provide may be sent to AI service providers, as described in our Privacy Policy.

AI suggestions are not professional advice

AI-generated content may be inaccurate, incomplete, outdated, culturally shallow, or inappropriate for your circumstances. Themecation is not a medical, legal, safety, financial, or professional advice service.

You are responsible for reviewing AI-generated recommendations before relying on them โ€” especially anything involving allergies, dietary needs, child safety, accessibility, travel risk, purchases, or health-related decisions. To the extent permitted by law, Themecation makes no guarantee about the accuracy, suitability, originality, or availability of any AI-generated output.

9. Cancellations and refunds

You can cancel a subscription where the app or our payment provider gives you that option. When you cancel, you generally keep access to paid features until the end of the current billing period, and your subscription will not renew after that.

Except where required by law or expressly stated at purchase, payments are non-refundable and partial periods are not refunded. If you believe you were charged in error, contact us at hello@themecation.com and we'll work with you in good faith.

10. Our intellectual property

The Service itself โ€” including the Themecation name, logo, software, design, text, graphics, and other materials we provide (excluding Your Content and third-party content) โ€” is owned by Themecation LLC or its licensors and is protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.

11. Suspension and termination

You may stop using the Service at any time. We may suspend, limit, or terminate your access โ€” with or without notice โ€” if we reasonably believe you have violated these Terms, created risk or legal exposure for Themecation or others, or if we discontinue the Service.

When your account ends, your right to use the Service stops. Sections that by their nature should survive โ€” including content licenses you've granted for already-public content, disclaimers, limitations of liability, and indemnification โ€” will survive termination.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. This includes any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content โ€” including AI-generated plans, recommendations, or shopping links โ€” will be accurate, complete, reliable, safe, or suitable for your needs. You use the Service, and rely on its content, at your own discretion and risk.

13. Limitation of liability

To the fullest extent permitted by law, Themecation LLC and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid Themecation in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. In those cases, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Themecation LLC and its owners, employees, and providers from any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

15. Changes to the Service and these Terms

We are actively building Themecation and may add, change, or remove features at any time. We may also update these Terms from time to time. When we do, we will update the "Last updated" date above, and if changes are significant we may provide additional notice through the app or by email.

Your continued use of the Service after updated Terms take effect means you accept the updated Terms. If you don't agree, please stop using the Service.

16. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Wisconsin, without regard to conflict-of-laws rules. You agree that disputes relating to the Service or these Terms will be handled in the state or federal courts located in Wisconsin, unless applicable law requires otherwise.
